I hereby acknowledge that I am of full age to and have the right to contract on my own in the State of Florida.  I am fully aware that HBA Hollywood Beauty Academy, LLC (hereafter known as “Hollywood”) in Orlando, FL operates a beauty academy for cosmetology, barbering, nail technician and esthetics. The students and staff at Hollywood are not being held out as skilled or trained professionals, and for that reason I am receiving services from Hollywood at a reduction in the prices customarily charged for similar services from a licensed professional. I further acknowledge that in the course of receiving such services, any damage to my hair, skin, nails or other parts of my body or my clothing may accidentally occur, and that I may not be pleased with the outcome of the services provided.  Nonetheless, in consideration of the reduction in price given for this work, I hereby waive and release, indemnify, and forever discharge Hollywood, its proprietors, officers or agents or any of its students or instructors from any and all claims, demands, causes of action, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to the services performed at Hollywood.  The provision of this waiver and release will continue in full force and effect even after termination of the services being provided to me, whether by agreement, by operation of law, or otherwise. I am fully aware that the students at Hollywood are learning and practicing techniques and are not licensed professionals.

Furthermore, I acknowledge that photos and videos may be taken of the services performed on me at Hollywood or while I am on Hollywood’s premises (hereafter known as “Materials”).  I agree that these Materials will solely belong to Hollywood. Hollywood is, and shall be, deemed the author of the Materials, regardless of how, when and where they are to will be used.  If, for any reason, I am considered the author or owner of the intellectual property rights in the Materials and they cannot vest in Hollywood, I irrevocably assign to Hollywood all rights, title and interest in the Materials, including the copyright and any renewal or extension of that copyright. I irrevocably waive any moral rights or similar rights under any principles of law which I may now have or later in any of the Materials. Furthermore, I irrevocably waive any right that I may have to inspect or approve the finished product or products and the advertising copy or other matter that may be used in connection with the Materials and/or the use to which they may be applied. Hollywood may unconditionally use and authorize or license to others, the right to use any of Materials in perpetuity in any form or media or in any way as Hollywood may deem fit.

I understand and confirm that by clicking I AGREE and making payment for services, I have read, understand and fully agree to the terms of this Waiver and Release and I have given up future legal rights. I have agreed to this Waiver freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to me. My acknowledgement and payment is proof of my intention to execute a complete this unconditional Waiver and Release of all liability to the full extent of the law.
